SONI SHRIVASTAVA ORAL ORDER 08-07-2025 The parties to the proceedings i.e. husband and wife are present in the Court today in pursuance to the earlier order dated 17.06.2025 and the petitioner is ready to take his wife along with him at Hubli in Karnataka where he is posted in the Railways Department.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 313, 498A, 504, 506, 509, 494 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
3. Learned counsel for the petitioner has also produced the tickets showing the reservation of both the husband and wife done for travel to Karnataka. Opposite party no. 2 also
Patna High Court CR. MISC. No.84484 of 2024(5) dt.08-07-2025 2/3 agrees to go along with her husband from the court premises itself.
4. In such view of the matter, let the above named petitioner, be released on provisional bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Lohia Nagar P.S. Case No. 14 of 2024, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./482(2) of the B.N.S.S., and subject to the further condition that the petitioner shall cooperate in the investigation/trial.
5. The learned court below would accept the bail bonds only on the satisfaction that both the husband and wife are staying together peacefully. The learned court below would fix another date in the matter to finally confirm the provisional bail granted to the petitioner after observing their relationship for a period of another two months.
6. It is expected that the husband and wife would lead a peaceful conjugal life without any unwanted interference from the parents of both the sides. It is also expected that if the
