2. Petitioner apprehends arrest in a case registered for the offence punishable under section 7 of the Essential Commodities Act, 1955 .

3. As per the prosecution case, on the alleged date and time , informant inspected the business premises of the petitioner and found shortage of 34.32 quintals of wheat and 60.05 quintals of rise in his godown .

4. It is submitted on behalf of the petitioner that petitioner has already returned the alleged shortage of food grains in the fair price shop/godown . Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the bail

6. Considering the submission of the petitioner that he has already returned the alleged shortage of food grains and also the fact that petitioner claims clean antecedent, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Araria in connection with Jokihat P.S. case No. 381 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
