JUSTICE ALOK KUMAR PANDEY ORAL JUDGMENT Date : 10-12-2024 In the instant writ petition, petitioner has prayed for the following relief (s) :- "(i) To direct and command the respondent concerned specially Respondent No. 3 to inquire and disposed of matter relating to khata No. 315/53, Khesra No. 2394/1300 area-13 Dismal (3 Katha), thana No. 247 and Jamabandi No. 153 under Mauza Salempur for which already a representation/application has been filed

Patna High Court CWJC No.18817 of 2024 dt.10-12-2024 2/3 before Respondent no. 3 by the petitioner on 16.10.2024 in connection with Notice letter No. 52/21 dated 16.08.2022 issued by Circle Officer, Bisfi.

(ii) To pass such order/orders in the shape of consequential relief to which the petitioner may be found legally entitled to in the facts and circumstances of case in hand of the petitioner."

2. Learned counsel for the petitioner submits that petitioner is aggrieved by the notice dated 16.08.2022 issued by the Circle Officer, Bisfi, Madhubani (respondent no. 3). It is submitted that the concerned authority has no jurisdiction to the said issue notice. It is submitted that petitioner has submitted his reply on 16.10.2024 in compliance of the said notice.

3. Learned counsel for the State submits that the aforesaid aspect is a matter of record. However, in case petitioner represents his grievance afresh, the same shall be looked into by the concerned authority.

4. Considering the facts and circumstances of the case, the present writ petition is disposed of with direction to the petitioner to represent afresh before the concerned authority raising the grievances, as has been raised in the present writ petition, within a period of four weeks from the date of receipt of a copy of this order.
