JUSTICE ARVIND SRIVASTAVA ORAL ORDER 16-02-2018 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Dhanaha P.S. Case No. 131 of 2017 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to previous enmity. As a matter of fact the present case is counter blast of Dhanaha P.S. Case No. 132 of 2017 lodged by the coaccused against the present informant and others. Similarly situated co-accused persons have been granted bail by this Court vide order dated 02.02.2018 passed in Cr. Misc. No. 6520 of 2018. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case and the
Patna High Court Cr.Misc. No.7754 of 2018(2) dt.16-02-2018 2/2 submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, 1st Bagaha, West Champaran in connection with Dhanaha P.S. Case No. 131 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
