JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2018 Petitioner apprehends his arrest in connection with Dhanarua P.S.Case No. 526 of 2016 registered under Sections 304B, 201 and 120B of the Indian Penal Code.

Petitioner is husband and case is dowry death. Submission of learned counsel for the petitioner is that statement of mother of victim has been recorded in paragraph-17 of the case diary and she has stated that deceased has disclosed her that during preparation of food her sari caught fire and due to that she received burn injuries and at that time all family members had gone to the ghat on the eve of chat festival and other witnesses have not supported the prosecution case.

Heard learned APP also, who has not controverted the above submission.

No.4821 of 2018 (3) dt.28-02-2018 2/2 Having heard both sides and in view of facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Masaurhi, in connection with Dhanarua P.S.Case No. 526 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in investigation and appear before the Investigating Officer as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
