Petitioner apprehends his arrest in Pakaridayal P.S. case no. 44 of 2016 instituted for the offence under Section(s) 302 and 120B/34. of the Indian Penal Code.

Learned counsel for the petitioner has submitted that he is not named in the F.I.R.The name of this petitioner has transpired in the supervision note of the Dy. S.P. The learned APP has submitted that process under Section 82 Cr. P.C. has already been issued by order dated 21.11.17.

In view of such, the anticipatory bail application is disposed of with direction to the petitioner to surrender in the Court below i.e ACJM-5, East Champaran, Motihari in connection with Pakaridayal P.S. case no. 44 of 2016, within a

Patna High Court Cr.Misc. No.9737 of 2018(2) dt.19-02-2018 2/2 period of four weeks from date of receipt of order and make prayer for regular bail which shall be considered and disposed off by the court below on its own merit, on the same day, after taking into consideration, that he is not named in the F.I.R. and his name has transpired in the supervision note of the Dy.
