1. The learned counsel for the opposite party no.2 files vakalatnama in Court, the same is accepted.

2. Heard learned counsel for the petitioner, learned counsel for the opposite party no.2 and learned APP for the State.

3. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 376, 493, 366, 354(D) and 313 and 34 of the Indian Penal Code read with Sections 3 and 4 of the D. P. Act.

4. The learned counsel for the opposite party no.2, at the outset, submits that he has instructions to make submission on behalf of the opposite party no.2 not to oppose the

Patna High Court CR. MISC. No.80236 of 2023(4) dt.13-02-2024 2/2 anticipatory bail application of the petitioner as the petitioner and the opposite party no.2 are living a peaceful conjugal life and opposite party no.2 is a major.

5. The learned counsel for the petitioner also concurs with the submission of the learned counsel appearing on behalf of the opposite party no.2.

6. Considering the submissions made by the learned counsel appearing on behalf of the opposite party no.2, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Gaya in connection with Mahila P. S. Case No.53 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
