The petitioner seeks bail in anticipation of his arrest in connection with Bajpatti P.S. Case No. 29 of 2017 dated 31.10.2017 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition Excise Act, 2016.

It has been alleged in the FIR that on seeing the police party two of the miscreants left behind their motorcycle and ran away. While running away, the purse of one of the miscreants fell down on the road and from the said purse, one Aadahar Card belonging to the petitioner was found.

Considering the aforesaid facts, the prayer for

Patna High Court Cr.Misc. No.4748 of 2018 (2) dt.05-02-2018 anticipatory bail of the above named petitioner is rejected. However, if the petitioner surrenders before the court below and seeks regular bail, the court below shall take into account the fact that the petitioner was not arrested on the spot.
