The petitioners apprehend their arrest in a case registered for the offence punishable u/s 409, 420 and 120 B of IPC. 3.

As per prosecution case, petitioners being the Ward Secretary of Ward No.12 allegedly embezzled the Govt. money of certain Govt. schemes by making interpolation in the measurement book of the said scheme.

It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. They have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. A

Patna High Court CR. MISC. No.80260 of 2024(2) dt.31-01-2025 2/3 supplementary affidavit has been filed on behalf of the petitioners and in para 4 and 5 of the supplementary affidavit, it is stated that the petitioners are ready to deposit Rs.4,00,000/- in installments. It is also stated that at the time of furnishing bail bond the petitioners will furnish a receipt of payment of Rs.2,00,000/- and rest amount of Rs.2,00,000/- will be paid in two equal installments. It is also stated that petitioners undertake to deposit the said amount in account of Ward Vikash Samiti Semra, Ward No.12 bearing Account No. 2310101322698 at Canara Bank, Gopalganj. Petitioners have no criminal antecedent.

Learned APP for the State opposed the prayer for bail. 6.

Having regard to the facts and circumstances of the case and considering the statements mentioned in para 4 and 5 of the supplementary affidavit, let the above named petitioners, be released on provisional bail for a period of four months, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Gopalganj (Town) P.S. Case No.276 of

Patna High Court CR. MISC. No.80260 of 2024(2) dt.31-01-2025 3/3 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Learned court below is directed to accept the bail bonds of the petitioners after satisfying that petitioners have deposited Rs.2,00,000/- in the account of Ward Vikash Samiti Semra, Ward No.12 bearing Account No. 2310101322698 at Canara Bank, Gopalgan and, later on, confirm the bail bonds of the petitioners after satisfying that the rest amount has been deposited in the said account.
