Petitioner seeks regular bail in connection with Jadia P.S. Case No.94 of 2024, registered for the offence punishable u/s 341, 323, 325, 354B, 316, 307, 379, 504, 506 and 34 of IPC. 3.
Allegedly, petitioner along with one another co-accused person have assaulted the informant and his wife due to which unborn child of the wife of the informant died in the womb. It is further alleged that other co-accused person has snatched Rs.3,000/- from pocket of the informant.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case. It is further submitted that there is no intention to assault the informant and
Patna High Court CR. MISC. No.82324 of 2024(3) dt.23-01-2025 2/2 his wife because petitioner and informant are own brothers and due to partition of ancestral house, the occurrence took place. Petitioner has no criminal antecedent and is under custody since 24.06.2024.

Learned APP for the State opposed the prayer for bail and submits that the case diary was called for and medical report has supported the prosecution case.

Considering the aforesaid facts and circumstances and the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of regular bail on his behalf is hereby rejected.

This application is accordingly dismissed.

However, petitioner shall be at liberty to renew his prayer for regular bail after examination of the informant. (Anjani Kumar Sharan, J) priyanka/- U T
