JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Ghorasahan P.S. Case No. 246 of 2019 registered for the offences punishable under Sections 406, 420, 34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.

It appears from the FIR that petitioner has given name of one boy to the informant for marriage with his daughter and thereafter negotiation was made and payment was also made but later on the person with whom marriage was fixed has refused to marry, as such the present case has been lodged. Submission of learned counsel for the petitioner is that at best he is mediator and he is no other way responsible for

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sikrahna at Dhaka, East Champaran, Motihari, in connection with Ghorasahan P.S. Case No. 246 of 2019, G.R. No. 887 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
