JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 28-03-2023 The petitioner, by way of this writ petition, seeks a direction to the respondent - Bank to transfer the amount deposited in the bank account of the petitioner's husband who died a natural death, to the bank account of the petitioner. The writ petition does not lie for the aforesaid purposes. It is not a Civil Court nor it can go into the factual
Patna High Court CWJC No.1843 of 2023(2) dt.28-03-2023 2/2 aspects of the matter. Upon being questioned, learned counsel for the petitioner states that the petitioner has pressed him to file this petition as she is very poor.
It is expected from lawyers to know the forum where a petition can be filed for redressal of the grievances of their clients. Frivolous writ petition filed before this Court knowing fully well that the same is not maintainable amounts not only to wasting the valuable time of this Court but also an act of misleading one's own client. The learned counsel being fully responsible for filing such a frivolous writ petition is imposed a cost of Rs.5000/- to be deposited with the Lawyers' Association of the Patna High Court. He shall also apprise this Court about compliance of the said order on the next date. For the purpose of only apprising this Court about compliance of the aforesaid order, list this case on 17.04.2023. The writ petition stands disposed of.
