JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-09-2023 At the outset, the learned counsel for the petitioner seeks a direction upon the Circle Officer, Rafiganj, District-Aurangabad to finally conclude the proceedings of the Encroachment Case No. 11 of 2021-22.

The learned counsel for the respondentState submits that in case the aforesaid encroachment proceedings are still pending, the same would definitely be concluded within a fixed
Patna High Court CWJC No.2761 of 2023(2) dt.26-09-2023 2/2 time frame.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the Circle Officer, Rafiganj, DistrictAurangabad to dispose off the aforesaid encroachment proceedings, if not already disposed off, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, after hearing the affected parties and in accordance with law, within a period of six weeks of receipt/production of a copy of this order. 4.
The writ petition stands disposed off on the aforesaid terms.
