2. This is the third attempt on behalf of the petitioner, who is in custody since 27.09.2016 and has renewed his prayer for bail in connection with Special Case No. 38 of 2016 arising out of Narpatganj P.S. Case No. 329 of 2016, having earlier been rejected by orders dated 08.03.2018 and 15.05.2019 in Cr. Misc. No. 11965 of 2018 and Cr. Misc. No. 15176 of 2019 respectively for the offences alleged under Sections 8(c)/20(B) (ii)(B) of the NDPS Act .
3. Learned counsel for the petitioner invites reference to the order of this Court dated 15.05.2019, by which the petitioner was granted liberty to renew his prayer for bail if the
Patna High Court CR. MISC. No.73818 of 2019(5) dt.19-01-2021 2/2 trial is not concluded within a period of four months. Thereafter by order dated 01.09.2020, an up-to-date status report through email was called for from the learned court below. A status report dated 05.09.2020 has since been received according to which the defense evidence has been closed and the matter is now pending for argument.
4. Learned APP appears and has been heard.
5. Having regard to the nature of accusations and gravity of offence alleged as well as the stage of trial, this Court is not inclined to grant the privilege of bail to the petitioner. The bail petition stands dismissed with liberty to the petitioner to move the learned court below for expeditious conclusion of the trial in the spirit of the order dated 15.05.2019.
