JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Jandaha P. S. Case No. 71 of 2019 registered for the offences punishable under Sections 25(1-b)a, 26, 35 of the Arms Act. As per F.I.R. it appears that while the informant was going by a motorcycle, his motorcycle was stopped and some miscreants have tried to snatch the motorcycle on the point of pistol. He raised hulla and people assembled there and the accused persons succeeded in fleeing away from the spot, but the local people damaged the motorcycle of the miscreants. The motorcycle showing the ownership of the petitioner, was recovered.

Submission of the learned counsel for the petitioner is that he has not been arrested at the spot and he has falsely been implicated in this case as his vehicle met with an accident.

Patna High Court CR. MISC. No.70099 of 2019(2) dt.11-12-2019 2/2 Nothing has been recovered from his possession. He is in custody for about 04 months. Charge sheet has already been submitted.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, Vaishali, Hajipur, in connection with Jandaha P. S. Case No. 71 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
