This application for regular bail arises out of Madhuban P.S. Case No. 163 of 2018, disclosing offence punishable under Section 307 and other allied Sections of the Indian Penal Code.
It is the case of the prosecution that there was a procession, led by co-accused Ajay Kumar, which passing through a road. The informant was also passing in his car with his driver, through the same road, when allegedly, his vehicle was forcibly made to stop by co-accused Dilip Kumar and Raj Kumar. They are said to have dragged the driver out of the vehicle and assaulted him.
Learned counsel for the petitioner has submitted that the main allegation of assault is against Dilip Kumar and Raj
Patna High Court CR. MISC. No.70134 of 2019(3) dt.05-03-2020 2/2 Kumar, who have been allowed regular bail by this Court by orders dated 12.09.2019, passed in Cr. Misc. No. 57650 of 2019 and 27.09.2019, passed in Cr. Misc. No. 59381 of 2019. Petitioner is in custody since 22.08.2019.
Considering the facts and circumstances and the nature of allegation against the petitioner, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned 4th Additional Chief Judicial Magistrate, East Champaran at Motihari, in Madhuban P.S. Case No. 163 of 2018. This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
