JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-11-2019 This application, for grant of anticipatory bail, arises out of Mashrak P.S. Case No. 120 of 2019, disclosing offences under Sections 363, 366(A) of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of informant.

Submission of learned counsel for the petitioner is that he has been implicated in this case only on the basis of suspicion and except suspicion, there is absolutely nothing against the petitioner and the girl has been recovered and her statement under Section 164 Cr.P.C. has been recorded, in which, she has not supported the case of prosecution rather she has given a different version.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts,

Patna High Court CR. MISC. No.75938 of 2019(2) dt.25-11-2019 2/2 this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J- I, Saran, in connection with Mashrak P.S. Case No. 120 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
