JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-04-2018 Heard learned counsel for the petitioners and the counsel appearing on behalf of the State as well as the counsel appearing on behalf of the informant.

Petitioners are apprehending arrest in connection with Sahpur P.S. Case No. 204 of 2017 for the offence under sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code . Learned counsel for the petitioners submits that the petitioners have no criminal antecedent and from the Fard-beyan itself it is evident that there was dispute in connection with fodder machine. The petitioners and informant have share in the fodder machine, the incident took place on 7.9.2017 but the written complaint was lodged on 2.10.2017.

Considering the fact that the petitioners have no

No.13909 of 2018(2) dt.05-04-2018 2/2 criminal antecedent and the fact that there was dispute as to the partnership in the fodder machine and the fact that there was inordinate delay in lodging the FIR, the court is inclined to grant bail to the petitioners, let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Danapur, Patna, in connection with Sahpur P.S. Case No. 204 of 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C.
