Mr. Bharat Lal ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Madhepura P. S. Case No. 187 of 2019 registered for the offence punishable under Section 392 of IPC.

As per F.I.R. three miscreants have snatched the cash of Rs.12,000/- on the point of pistol. Petitioner is not named in the F.I.R. It appears from the impugned order that later on, his name transpires on the confessional statement. He is accused in two other cases also.

Submission of the learned counsel for the petitioner is that he was arrested in connection with other cases. His confessional statement has been recorded by the police and made accused in this case. Nothing has been recovered from his possession. He is in custody for 08 months. The other accused having similar allegation has been granted bail by a Co-ordinate

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Judicial Magistrate 1st Class, Madhepura, in connection with Madhepura P. S. Case No. 187 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition to appear before the local police station of his area in the second week of each month for a period of six month, so that, the police may watch his conduct. Let a copy of this order be communicated to the S.P. of Madhepura for needful.
