In this case, the petitioner is seeking regular bail in connection with Ghoswari P.S. Case No. 31 of 2021, registered for the offences punishable under Sections 147, 341, 504 and 506 of the IPC and Section 27 of the Arms Act.

As per allegation, having seen the police party, the petitioner, along with co-accused Diwakar Yadav, Tinku Yadav and Mukesh Yadav started fleeing away, after throwing fire arms. Six cartridges and one country-made pistol were recovered, which were lying on the ground.

The learned counsel for the petitioner has submitted that the petitioner was not arrested at the spot. Nothing was recovered from his possession. He is under custody since 14.07.2022 and on similar footing, co-accused Karamvir Kumar @ Karamvir

Patna High Court CR. MISC. No.1197 of 2023(2) dt.03-04-2023 2/2 Yadav @ Ajay Yadav has been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 30297 of 2022.

Considering the above-mentioned facts and circumstance, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Barh, Patna in connection with Ghoswari P.S. Case No. 31 of 2021, subject to the following conditions:- (i) The petitioner shall appear physically on each and every date and on his failure in appearance on two consecutive dates, the learned court below shall be at liberty to cancel his bail bond.

(ii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(iii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
