2. The petitioner seeks bail in connection with Lakhisarai P.S.Case No. 587 of 2023 instituted for the offences punishable under Sections 420, 376 of the Indian Penal Code.
3. The prosecution case in short is that petitioner used to established sexual relationship with the informant continuously for about seven years in the pretext of marriage and she also became pregnant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that informant is legally wedded
Patna High Court CR. MISC. No.82504 of 2023(3) dt.06-03-2024 2/2 wife of one Vinod Kumar and living in her sasural. The case has been compromised between the parties. The informant and the petitioner is ready to live with the informant as a husband and wife.
5. Learned APP opposes the prayer for bail.
6. Perused the FIR, statement of victim recorded under section 164 of the Cr.,P.C, it appears that informant was in a love affair with the petitioner and compromised has been filed by both the parties and they are ready to live together, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai/ concerned court in connection with Lakhisarai P.S.Case No.587 of 2023.
