Petitioner apprehends arrest in a case registered for the offence punishable under sections 307, 325, 147, 149, 341, 323 and 324 of the Indian Penal Code.
As per the prosecution case, all the accused persons including this petitioner armed variously assaulted the informant side in which seven persons sustained injury. It is submitted on behalf of the petitioner that this petitioner namely Mintoo @ Md. Mintoo @ Margul Hasan Shah has not committed any such offence as alleged. There is no specific allegation of assault is against the petitioner. The specific allegation of overt-act is against other co-accused persons. Similarly situated co-accused persons have already
Patna High Court CR. MISC. No.1691 of 2023(3) dt.19-06-2023 2/2 granted bail by the Co-ordinate Bench of this Court vide order dated 06.01.2023 in Cr. Misc. No. 48946 of 2022. Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Darbhanga in connection with Jalley P.S. case no 164 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
