JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-11-2019 This application, for grant of anticipatory bail, arises out of Pachrukhi P.S. Case No. 259 of 2019, disclosing offences under Sections 272 and 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act. As per F.I.R. there is allegation of recovery of 4.320 litres of liquor from the house of Krishna Choudhary and petitioner is said to have succeeded in fleeing away. Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been made accused in this case and except the allegation that he succeeded in fleeing away, there is no further allegation of recovery either from his house or from his instance and furthermore, there is no source of his identification.
