JUSTICE SHIVAJI PANDEY ORAL ORDER 10-07-2020 Heard learned counsel for the petitioners and learned APP for the State through virtual Court proceeding. In this case, the petitioner is seeking anticipatory bail in connection with Paharpur P.S. Case No.230 of 2019, registered for the offence under Sections 341, 323, 354, 379, 504 and 506/34 of the Indian Penal Code.

As per the F.I.R., on 09.07.2019 at about 05:30 A.M. while the niece of the informant was going to coaching centre the accused persons including these petitioners passed vulgar comment on her but, she went to her coaching centre. When she was returning from the coaching, again the accused

No.71731 of 2019(3) dt.10-07-2020 2/3 persons including these petitioners caught her hand and tried to get her sited on bullet motorcycle but anyhow she saved herself and narrated the entire incident to the informant. It has also been alleged that when the informant asked the accused persons whey they used to comment vulgar language to her niece, the accused persons caught his collar and snatched his gold Hanumani worth Rs.3,000/- and threatened of dire consequences. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case as petitioner no.1 has lodged an F.I.R. against the informant and others on 10.07.2019 vide Paharpur P.S. Case No. 224 of 2019 and only with a view to save himself the informant has lodged the present case on 14.07.2019 giving situation of occurrence of 09.07.2019. He further submits that co-accused Ankit Kumar has been granted anticipatory bail by a coordinate Bench of this Court in Criminal Miscellaneous No.69676 of 2019.

Looking to the entire facts and circumstances of the case, let the above-named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand
