The petitioner is apprehending his arrest in connection with POCSO Case no.76/2017 registered for offences punishable under Sections 354, 354(A), 354(C ), 354(D) & 506 of the Indian Penal Code.
Allegation against the petitioner is of fixing mobile on the window of informant and making her video. The informant is a minor girl.
Submission of the learned counsel for the petitioner is that there is nothing against the petitioner and his Mobile has also been snatched.
Heard learned A.P.P. also.
Having heard both sides and in view of allegation of photography of a minor girl inside the room, I am not inclined to
Patna High Court Cr.Misc. No.13259 of 2018 (2) dt.05-04-2018 2/2 grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.
With the aforesaid observation, this application is dismissed.
