The petitioner seeks regular bail in connection with Rail Kiul P.S. Case No. 165 of 2019, registered for offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
The allegation against the petitioner, as per FIR, is that police intercepted the petitioner, after he get down from the train and recovered a total quantity of 39 litres of illicit liquor kept in bag.
Learned counsel appearing on behalf of the petitioner submits that the petitioner has got no criminal antecedent and has falsely been implicated in this case by the police with
Patna High Court CR. MISC. No.74797 of 2019(2) dt.11-12-2019 2/2 oblique motive. He further submits that illicit liquor has not been recovered from the conscious possession of the petitioner. He further submits that the petitioner is in custody since 11.09.2019.
Having regard to the submissions made by the parties and taking into consideration the fact that the petitioner has got no criminal antecedent and he is in custody since 11.09.2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above-named, be enlarged on bail on furnishing bail bonds of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge, Excise, Lakhisarai in connection with Rail Kiul P.S. Case No. 165 of 2019.
