2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 115 (2), 118 (1) (2), 109, 126 (2) and 3 (5) of the Bharatiya Nyaya Sanhita, 2023.

3. The case of the prosecution is that the brother of the informant was being assaulted with 'knife' by unknown miscreants.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that informant merely suspects that the petitioner and others have got him assaulted with 'knife'. It is further submitted from perusal of the order of the trial Court, it would transpire that the

Patna High Court CR. MISC. No.76371 of 2025(2) dt.19-11-2025 2/2 injured himself has identified one accused namely, Vibhanshu Kumar @ Kishu Kumar, as the person, who attacked him with 'knife'. The injured has not named any other assailant. It is further contended that the informant and the petitioners are cousins. There is no specific allegation against this petitioner. Moreover, the person against whom there is specific allegation of assault, i.e. Vibhanshu Kumar @ Kishu Kumar, has already been granted the privilege of bail vide order dated 12.11.2025 passed in Cr. Misc. No. 54007 of 2025. The petitioner is languishing in judicial custody since 05.08.2025. 5.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Aurangabad (Town) P.S. Case No. 315 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad.
