JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-12-2019 This is an application for grant of anticipatory bail in connection with Sasaram Town (Model) P. S. Case No. 320 of 2017, disclosing offences under Sections 341, 504, 506, 354, 354B, 326(B), 34 of the Indian Penal Code.
As per F.I.R. allegation against the petitioner is of talking the granddaughter of the informant and threatening to throw acid on her, if she is not talking with him. Submission of the learned counsel for the petitioner is that the allegations are false and concocted. He has no criminal antecedent. He is ready to abide by any condition imposed upon him.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that petitioner has been given benefit of Section 41(1) of Cr.P.C.
Patna High Court CR. MISC. No.75909 of 2019(3) dt.09-12-2019 2/2 Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Sasaram, in connection with Sasaram Town (Model) P. S. Case No. 320 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that in no way he will try to threaten the granddaughter of the informant or his family members or statute of the informant, otherwise, the informant is at liberty to move for canncellation of his bail bonds.
