1. Though, the present writ petition has been filed for directing the respondents to remove the encroachment made over public land appertaining to Khata No.200, Khesra No.387, 388 and 390, situated at Mauza-Lahuria, Thana No.393, P.O.- Gopalpur, District-Banka, however, at the outset, the learned counsel for the petitioner has submitted that the Circle Officer, Rajoun, District-Banka, i.e. the respondent no.4 has already inititated encroachment proceeding, vide Encroachment Case No.26 of 2023-24, hence he be directed to conclude the same within a stipulated time frame.
2. Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the respondent no.4 to
Patna High Court CWJC No.17777 of 2024(2) dt.25-11-2024 2/2 pass the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in connection with Encroachment Case No.26 of 2023-24, in case the same has not yet been passed, in accordance with law and after hearing the affected parties within a period of six weeks of receipt/production of a copy of this order.
3. The writ petition stands disposed off on the aforesaid terms.
