2. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 117(2), 75, 109, 132, 303(2), 352 and 324(4) of B.N.S., 2023.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleged that he received an information that Shashi Ranjan Rai and Madhurendra Rai indulged in illegal trade of liquor. Accordingly, the police force reached the house of Shashi Ranjan Rai and

2/4 Madhurendra Rai. Further, Puja Kumari, daughter of Shashi Ranjan Rai, assaulted the lady member of raiding team. Thereafter, Madhurendra Rai came with unsocial elements and started assaulting the police force. Further, Shashi Ranjan Rai assaulted lady officer Nikita Kumari with bamboo stick and his two sons, namely, Sachin Kumar and Rahul Kumar pulled the informant on the ground and assaulted causing injury on arms. Further, Shashi Ranjan Rai assaulted lady officer Mamta Kumari causing injury on head and fracture of hand. Thereafter Madhurendra Rai snatched her mobile. Further, Abhishek Kumar assaulted constable Rajesh Kumar by brick causing injury on waist while Sanjay Rai assaulted constable Awakash Kumar causing injury on his right arm and Chandan Kumar assaulted constable Sabita Devi with Danda causing injury on her left leg while Pramod Rai assaulted Niranjan Kumar causing injury. Further, two motorcycles were seized.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that date of occurrence is 26.07.2025 and the FIR came to be instituted on 29.07.2025, i.e., after a delay of three days without any plausible explanation. It is also submitted that it does not appear probable that after three days the informant with such precision could have remembered who

3/4 assaulted whom, where and by what. It is further submitted that though in the FIR it is alleged that informant received a secret information that Madhurendra Rai and Shashi Ranjan Rai indulged in illegal trade of liquor but then both are persons with clean antecedent. It is also submitted that police might have received an information but then every information is not a correct information and based on the said information, the force entered the house of Shahsi Ranjan Rai and started misbehaving with the family members when an altercation took place and Madhurendra Rai along with Shashi Ranjan Rai, who were working in the field, came and the issue escalated but then as far as allegation of assaulting the force is alleged, that is an exaggerated allegation.

It is also submitted that not a single drop of liquor was seized from the house of either Madhurendra Rai or Shashi Ranjan Rai nor in the FIR, it is alleged that the accused persons tried to remove liquor from the place of occurrence. It is also submitted that from perusal of the order impugned, it would manifest that the same discusses the injury report of Mamta Kumari only which amply demonstrates that other officers including the informant were not injured in the occurrence.

It is reiterated and submitted that petitioners are persons with clean antecedent and there is a delay of three days in instituting the FIR and the order impugned only discusses the injury of Mamta Kumari but then the said injury is on little finger which is not the vital part of the body. It is lastly submitted that petitioners will not abscond rather will cooperate in the investigation to prove their innocence.

5. The learned APP for the State opposed the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioners, let petitioners, above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Tariyani P.S. Case No.155 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
