The petitioner apprehends arrest in connection with Turkauliya P.S.Case No.564 of 2015 pending in the Court of CJM, East Champaran at Motihari registered for an offence under Section 307 and other Sections of the IPC.

This is the second attempt of the petitioner to obtain anticipatory bail. His prayer for anticipatory bail was rejected on 15.06.2016 in Cr.Misc.No.22319 of 2016 considering the fact that there was specific allegation that he had caused grievous injuries which is fracture on the left side of frontal bone on the head of injured.

The contention of learned counsel for the petitioner is that the matter has been compromised and the informant does not

This Court while rejecting the prayer for anticipatory bail had directed the petitioner to surrender before the court below where his prayer was directed to be considered on the same day on merit without being prejudiced by the order of this Court. In spite of direction, the petitioner remained silent for more than 18 months without any plausible reason.

Considering the grievous nature of injuries, facts and circumstances of the case, I am not inclined to reconsider his prayer for anticipatory bail. His prayer for anticipatory bail is rejected.
