Petitioners seek regular bail in connection with Revilganj P.S. Case No.273 of 2019, for the offence punishable under Sections 341/323/307/447/337/379/34 of the Indian Penal Code.

The allegation against the petitioners is that the petitioners along with other accused persons surrounded the informant and co-accused Mannan Mansuri assaulted the informant by means of iron rod causing him injury. Mr. Manoj Kumar, learned counsel for the petitioners submits that the petitioners have not committed any offence in the manner alleged. Learned counsel further submits that from

No.72556 of 2019(2) dt.04-12-2019 2/2 perusal of the First Information Report, it would be evident that the allegation of assault is upon the other co-accused and there is no specific overt act against the petitioners. Learned counsel further submits that injuries caused to the informant are simple in nature except injury No.1 for which the opinion of the doctor has been reserved. Learned counsel further submits that the petitioners are in custody since 08.09.2019. Learned counsel further submits that petitioners have got no criminal antecedent. Having regard to the submissions made by the parties and taking into consideration the fact that no specific overt act has been alleged against the petitioners and the petitioners have got no criminal antecedent and are in custody since 08.09.

2019, I am inclined to grant regular bail to both the petitioners. Accordingly, let both the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra, in connection with Revilganj P.S. Case No.273 of 2019.
