1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 76, 352 and 3(5) of the BNS as well as Section 12 of the POCSO Act.

Learned counsel for the petitioners submits that petitioners are persons with clean anticipatory and the informant alleges that on 08.05.2025 there was a wedding ceremony in the family and the family members were going on the road singing and DJ was playing when Pappy Sada (petitioner no. 3) forcibly

No.79813 of 2025(2) dt.08-12-2025 2/3 covered the mouth of the granddaughter of the informant with a towel and Rajanand Sada (petitioner no. 1) held her both legs and Jay Ram Sada (petitioner no. 2) unveiled her and started acting inappropriately, accordingly, the victim raised an alarm when petitioner no. 2 punched her in the stomach.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that on the date of occurrence a wedding procession was going and DJ was playing at a very high volume which was objected by the petitioners and their side on which an altercation took place in which both sides assaulted each other but then the issue was pacified but subsequently the instant FIR came to be instituted with an exaggerated allegation for reasons best known to the informant. It is next submitted that the date of occurrence is 08.05.2025 and the FIR came to be instituted on 07.06.2025 i.e. after a delay of nearly more than 29 days of the occurrence which casts as aspersion on the case of the prosecution. It is reiterated and submitted that petitioners are not the criminals.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the submissions made by the learned

No.79813 of 2025(2) dt.08-12-2025 3/3 counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Bahadurpur P.S. Case No. 279 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS. (Satyavrat Verma, J) Kundan/- U T
