2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 303(2), 109, 351(2), 352 and 3(5) of the B.N.S..
3. As per prosecution case, on 17.07.2024, while the informant was returning home on his pick-up van and reached near Ghorpokhar bridge, all the F.I.R. named accused persons, including this petitioner, surrounded him and this petitioner attacked with Garasa on the head of the informant and thereafter all the accused persons attacked the informant by means of iron rod and lathi and also snatched Rs. 25,000/- cash.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case. As per F.I.R., all the 10 accused
Patna High Court CR. MISC. No.81058 of 2024(3) dt.23-01-2025 2/2 persons named in the F.I.R. are alleged to have assaulted the informant but doctor has found only one injury on the body of the informant which itself falsifies the entire prosecution case. There are general and omnibus allegations against this petitioner. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the aforesaid facts and circumstances, nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara, in connection with Udwantnagar P.S. Case No. 306 of 2024, subject to condition as laid down under Section 482 of the B.N.S.S..
