JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Bettiah (Muffasil) P. S. Case No. 391 of 2019 registered for the offences punishable under Sections 413, 414, 34 of IPC. As per prosecution case petitioner was arrested along with stolen motorcycle.

Submission of the learned counsel for the petitioner is that the F.I.R. itself shows that three persons were ridding on the motorcycle and two persons were arrested including the petitioner. He has falsely been implicated in this case, having no criminal antecedent. As a matter of fact, other accused was driving the motorcycle. He is in custody for about five months. Charge sheet has already been submitted, and as such, there is no chance of tampering with the evidence.

No.70097 of 2019(2) dt.11-12-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Bettiah, West Champaran, in connection with Bettiah (Muffasil) P. S. Case No. 391 of 2019 , subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
