13-02-2018 Heard Sri Krishna Prasad Singh, learned senior counsel assisted by Sri Saket Kumar Singh, learned counsel for the petitioners and Sri Ajit Kumar, learned Addl. Public Prosecutor. Three petitioners, apprehending their arrest in Aurangabad (Muffasil) P.S. Case No. 6 of 2018 registered for offence under Sections 379, 411 of the Indian Penal Code and Section 40 of Bihar Minor Mineral Concession Rules, 1972, have prayed for grant of bail in the event of their arrest or surrender.

By way of referring to F.I.R., learned senior counsel for petitioners submits that petitioners have falsely been implicated in the present case.

Patna High Court Cr.Misc. No.7414 of 2018(2) dt.13-02-2018 2/2 Besides hearing, I have also perused the material on record and after going through the same, I am of the opinion that it is a fit case for extending the privilege of anticipatory bail.

Accordingly, in the event of arrest or surrender within a period of six weeks from today, let aforesaid three petitioners namely 1. Randhir Kumar, 2. Indrajeet Kumar @ Indrajeet Kumar Singh and 3. Amrendra Kumar Singh @ Amrendra Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Muffasil P.S. Case No. 6 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J.) anay U T
