JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-11-2019 This application, for grant of anticipatory bail, arises out of Majhaulia P.S. Case No. 242 of 2019, disclosing offences under Sections 341, 323, 325, 504, 307 and 34 of the Indian Penal Code.

Petitioner no. 1 happens to be son of the informant and petitioner no. 2 happens to be daughter in law and allegation against them is of assaulting the informant.

Submission of learned counsel for the petitioners is that the occurrence took place in spur of moment and they are ready to abide by any condition imposed on them. Heard learned A.P.P. also as well as learned counsel for the informant. They have opposed the prayer for anticipatory

Patna High Court CR. MISC. No.69959 of 2019(2) dt.14-11-2019 2/2 bail on the ground that the informant was under treatment for seventeen days in PMCH.

Having heard both sides, considering the facts and circumstances, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Majhaulia P.S. Case No. 242 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
