JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-12-2019 The petitioner seeks bail in anticipation of his arrest in connection with Sarsi P.S. Case No. 120 of 2019, dated 12.07.2019, instituted for the offences under Sections 186, 224, 225, 323, 332, 341, 342 and 353 of the Indian Penal Code.

According to the accusation in the F.I.R., when the police party had reached the house of the petitioner to arrest him on a warrant which was issued against him, a ruckus

Patna High Court CR. MISC. No.72564 of 2019(2) dt.11-12-2019 2/2 was created and the petitioner could manage to escape from the net of the police.

Hence the F.I.R.

In the case in which warrant had been issued against the petitioner for which the police party has gone to his house for arresting him, the petitioner has been granted bail.

If that be so, if the petitioner surrenders before the Court below, that aspect also would be taken into consideration by the Court below while disposing off such bail petition, if the same is filed within a period of four weeks. However, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. The prayer for anticipatory bail of the petitioner is, accordingly, rejected, but with the aforenoted observation. (Ashutosh Kumar, J) Praveen-II/- U T
