The petitioner seeks anticipatory bail in Khizarsarai P.S. Case No.74 of 2017 instituted for the offences under Sections 341, 343, 504, 506 and 307/34 of the Indian Penal Code.

It has been alleged that scuffle took place between the rival parties which led to institution of case and counter case from both sides. In the First Information Report it has been alleged that there is land dispute and petitioner was uprooting Raai forcibly in the filed of the informant. On protest he began to abuse him and gave threatening to kill him. Petitioner assaulted Pawan on his head and he become unconscious.

Patna High Court Cr.Misc. No.11902 of 2018 (3) dt.28-02-2018 In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected. However, if the petitioner surrenders before the court below within a period of four weeks, the court below will pass an order on the same day looking to the fact that there is a case and counter case without being prejudiced by the order passed by this Court.
