JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-01-2025 The present writ has been filed seeking the following relief:- "1(i). For issuance of an appropriate writ(s), order(s), direction(s) in the nature of mandamus commanding and directing the respondents not to take possession of the residential plot of the petitioner bearing Khata No. 176, Khesra 714, Area 46 decimal, situated at Mauza-Bandpura, Thana No. 263, Block-Katra, District Muzffarpur, as the same is being done without initiating any encroachment proceeding under the Bihar Public Land Encroachment Act, 1956 or under any other Act and restore the brick boundary wall of the petitioner, which has been demolished without any notice to the petitioner and without giving him an opportunity to establish that the land in question belongs to him."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate, Muzaffarpur, for redressal of his aforesaid grievances. Liberty, so sought, is granted. 3.

It is needless to state that in case the petitioner approaches the District Magistrate, Muzaffarpur, by filing appropriate representation, within a period of four weeks from today, the same shall be disposed off, by passing a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter.
