2. Petitioner apprehends his arrest in a case registered for the offences punishable under section 498A of the Indian Penal Code.

3. The case is one under section 498A and the petitioner is husband. The complaint case discloses an allegation of demand of dowry and torture.

4. It has been submitted on behalf of the petitioner that the marriage has been solemnized way back in the year 2011 and earlier also the case filed under section 2018 in which a

No.84588 of 2024(4) dt.16-07-2025 2/3 compromise had been effected and the parties started staying together however, the parties again separated and the petitioner has also filed a case for restitution of conjugal rights under section 9 of the Hindu Marriage Act and he is, till date, ready to keep his wife.

The learned counsel for the O.P.No. 2 appearing through legal aid submits that the petitioner has been treating the complainant with cruelty and this is the reason why it is impossible for the OP.No.2 to stay along with the petitioner. It is also submitted that a maintenance case has also been filed by the OP.No.2 in which till date the petitioner has not appeared. The petitioner is directed to appear in the maintenance proceeding so that the case may reach to its logical end.

6. At this stage, the learned counsel for the petitioner makes an offer to pay a sum of Rs. 4,000/- per month to the OP.No.2 subject to final outcome of any maintenance or collateral proceeding.

7. Considering all the above mentioned facts and circumstances, I am inclined to grant privilege of anticipatory bail to the petitioner. Let, the petitioner in the event of his arrest/ surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)

No.84588 of 2024(4) dt.16-07-2025 3/3 with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/ successor court in Complaint case no. 8407 (C) of 2023, subject to condition as laid down under section 438(2) of the Cr.PC and subject to the further condition that the petitioner shall cooperate in investigation/ trial.

Learned counsel for the O.P.No. 2 under instruction, submits that she undertakes to provide her bank account details to the petitioner within a period of two weeks from today, if the O.P.No. 2 furnishes the bank account in which the amount can be transferred, and yet the petitioner fails to give the aforesaid amount on two consecutive dates to O.P.No.2, the O.P.No.2 would be at liberty to file cancellation of bail .
