JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Minapur P.S. Case No. 05 of 2019 registered for the offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

Petitioner no. 1 happens to be father of the informant and he gave farsa blow causing head injury to informant. So far as petitioner no. 2 is concerned, she happens to be second wife of petitioner no. 1 and petitioner no. 3 happens to be son of petitioner no. 2 from her first husband. Petitioner no. 2 and petitioner no. 3 are said to have participated in the fight. Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, petitioner no. 2

Patna High Court CR. MISC. No.71831 of 2019(2) dt.18-12-2019 2/2 namely Shabrim Begum @ Afra Devi and petitioner no. 3 Sanjeet Kumar @ Md. Samim, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 05 of 2019, subject to conditions as laid down under Section 438(2) of the CrPC.

So far as petitioner no. 1 namely Md. Ishu @ Md. Ishuf @ Ishuf is concerned, I am not inclined to extend the privilege of anticipatory bail to petitioner no. 1 and accordingly, his prayer for anticipatory bail stands rejected. (Hemant Kumar Srivastava, J) khushbu/- U T
