2. The petitioner seeks regular bail in connection with N.D.P.S. P.S. Case No. BRBU10P0019502023 arising out of Rajpur P.S. Case No. 334 of 2023 instituted for the offences punishable under Section 20(b)(ii)(A) of the Narcotic Drugs and Psychotropic Substance Act.

3. It is a case of recovery of 815 gram Ganja from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that nothing has been recovered from the possession of the petitioner, petitioner has got clean antecedent and he is in

Patna High Court CR. MISC. No.79824 of 2023(2) dt.19-12-2023 2/2 custody since 19.09.2023.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and the period of detention of the petitioner, let the petitioner above named be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned District Judge - cum - Special Court, N.D.P.S.
