The petitioner seeks bail in connection with Begusarai Town P.S. Case No.364 of 2018 registered for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation against the petitioner is to have caused death of son of the informant by causing firearm injury.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case. It has further submitted that name of the petitioner was surfaced on the basis of confessional

No.79582 of 2023(2) dt.19-12-2023 2/2 statement of other co-accused person, who has already been granted bail by one of the learned co-ordinate Bench of this Court vide order dated 08.08.2022 passed in Cr. Misc. No. 13760 of 2022. It is further submitted that the petitioner is in custody since 10.03.2023.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and similarly situated co-accused persons have already been granted bail by co-ordinate Bench of this Court as well as period of custody of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Begusarai Town P.S. Case No.364 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Begusarai.
