JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State through the virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 338, 395, 427, 435, 412, 120(B), 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has antecedent of four cases and is in custody since 11.08.2022.

The informant alleges that five hundred miscreants came and damaged the petrol pump of the informant as detailed in the FIR and looted cash.

Learned counsel for the petitioner submits that FIR was against unknown and petitioner was arrested in a different

Patna High Court CR. MISC. No.673 of 2023(2) dt.04-03-2023 2/2 case and was remanded in the present case. It is further submitted that the mob attacked the petrol pump as they were agitating against Agniveer policy of the government. It is next submitted that the antecedent of the petitioner also relates to the same Agniveer policy of the government against which students were agitating.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the aforesaid submission and period of custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bettiah Town (Kalibagh OP), P.S. Case No. 460 of 2022.
