2. The present petition has been preferred for the following relief(s):
"(i) to issue a writ preferably in the nature of mandamus for directing and commanding the respondent authority concerned to construct the Panchayat Sarkar Bhawan over the land appertaining to Khata No. 1210, Plot No. 2365 measuring an area of 60 decimal situated at Gram Panchayat Siur, Block P.S. Roh, district-Nawada which is most suitable place from all the corner
Patna High Court CWJC No.19261 of 2025(2) dt.02-12-2025 2/3 having approach road/Sadak, but the Respondent authority in connivance with sitting Mukhiya of the said Gram Panchayat is adamant to construct the proposed Panchayat Sarkar Bhawan in the land appertaining to Khata No. 1210, Plot No. 2843 measuring an area of 70 decimal which is far away from the approach of villagers and even there is no approach road and not suitable place to construct the proposed Panchayat Sarkar Bhawan which is also contrary to the guideline/circular issued by the State of Bihar but despite apprising all these situations to the Respondent authorities concerned by the petitioner and other villagers and other Panchayat level authority i.e. Sarpanch, Up-Mukhiya and Ward Members, the Respondent authorities are not taking any action in the matter.
(ii) To forthwith stay the construction of proposed Panchayat Sarkar Bhawan over the land appertaining to Khara No. 1210, Khesra No. 2843 situated at Gram Panchayat- Siur, Block + P.S.-Roh, district- Nawada which is far from the approach of villagers and suitable place to construct proposed Gram Panchayat Bhawan as per guidelines and circular of the State Government.
(iii) And/or any other relief or reliefs for which the petitioner is found entitled in the facts and circumstances of this case."
3. After some argument, learned counsel for the petitioner submits that he shall be bringing to the notice of the Collector, Nawada regarding the highhandedness attitude of the
Patna High Court CWJC No.19261 of 2025(2) dt.02-12-2025 3/3 Mukhiya in not selecting a centrally located place for construction of Panchayat Bhawan by filing appropriate representation alongwith all the connecting documents.
4. Learned State counsel submits that if such petition is filed, it shall be taken to its logical conclusion.
5. In that background, the writ petition stands disposed of allowing the petitioner to approach the Collector, Nawada (respondent no. 3) in next four weeks.
6. If such petition is filed, the Collector, Nawada is duty bound to look into the matter and after hearing the parties, pass a reasoned order.
7. With the aforesaid observation, the writ petition stands disposed of.
