2. The petitioner seeks bail in Hajipur Town P.S. Case No. 191 of 2019, registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. Earlier, the bail petition of petitioner was rejected twice, vide orders dated 06.08.2021 and 24.08.2022 passed in Cr. Misc. Nos. 4349 of 2021 and 23974 of 2022, respectively.

4. The trial court report dated 24.01.2024 indicates that till date, not a single witness has been examined on behalf of prosecution. Petitioner is in custody since 27.08.2020.

5. Considering the period of custody and tardy

Patna High Court CR. MISC. No.82057 of 2023(3) dt.16-02-2024 2/2 progress of trial, the prayer for bail of petitioner is allowed.

6. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Vaishali at Hajipur, in connection with Hajipur Town P.S. Case No. 191 of 2019.
