The petitioners apprehend their arrest in Complaint case No. 1120 of 2015 for the offences allegedly committed by the petitioners under Section 420, 467, 468, 354/34 and 323 of the Indian Penal Code.
The gist of the allegation as made in the complaint petition is that the complainant executed a deed of agreement to sale of a piece of land. The accused persons paid Rs. 10 lacs but fraudulently got the signature of complainant of receipt of Rs. 17,50,000/-.
The learned counsel for the petitioners submits that the complainant received Rs. 17,50,000/- but later on she retracted from her statement made in the agreement and wanted to get more
Patna High Court Cr.Misc. No.25795 of 2018 (2) dt.07-05-2018 2/2 money. Prior to institution of this case the petitioner No.1 filed Sadar P.S. case No. 102 of 2015 and the police after investigation submitted charge sheet finding the case true. It appears that the dispute arose out of agreement. The complainant accepted receipt of Rs. 10 lacs but she alleged that her signature was obtained fraudulently. Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Complaint case No. 1120 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
