The petitioner has filed the instant application for grant of bail in a case registered under sections 18, 28, 30 and 22 of the N.D.P.S Act.

As per the allegation in the FIR, on search, Rs. 1 lakh in cash was recovered from the petitioner, Rs. 2 lakh in cash was recovered from the co-accused Dharmendra Singh and the third accused person managed to escape throwing a bag from which 3.8 Kgs of opium was recovered.

It is submitted by learned counsel for the petitioner that the FIR itself shows that no recovery of any narcotic or psychotropic substance has been made from the petitioner, he is in custody since 25.04.2019 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the above stated facts, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Gaya in connection with N.D.P.S. Case No. 39 of 2019 arising out of Barachatti P.S. Cacse No. 176 of 2019 (District Gaya).
