JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-04-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kuchaikot P.S. Case No.354 of 2017 registered for the offences punishable under Sections 147,148,149,341,323,379,427,436,504 and 506 of the Indian Penal Code.

Petitioner is not named in the first information report and the impugned order goes to show that in course of investigation, the name of petitioner came in this case but no specific overt act has been attributed against the petitioner. Moreover, it is submitted on behalf of the petitioner that on 20.12.2017 boiler of Sugar Mill was blasted, as a result of which several labourers sustained injuries and a mob made protest

Patna High Court Cr.Misc. No.23948 of 2018 (2) dt.25-04-2018 2/2 against the owner of Sugar Mill and Kuchaikot P.S.Case No. 355 of 2017 was registered against the owner of Sugar Mill. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Gopalganj in Kuchaikot P.S. Case No.354 of 2017 subject to condition as laid down under Section 438(2) of the Cr.P.C.
